  1. Following are the limitations and requirements for the purchase and use
  2. of Painless Accounting, Inc. source code.
  3.  
  4. We have spent many many hours away from our families inorder to bring
  5. you the highest possible quality in software. Basically all we ask is
  6. you please respect our rights and wishes, and we will respect yours.
  7. You must intial each point below, sign the bottom and have a notary
  8. public sign and stamp the form. Mail the completed form with payment.
  9. Thank you for supporting Painless Accounting, Inc. and the shareware
  10. concept.

  12. First lets cover the costs of the source code.

  22.     __________ I UNDERSTAND THAT THE SOURCE CODE, OR ANY PROGRAMS
  23.                GENERATED FROM THE SOURCE CODE CANNOT BE SOLD OR
  24.                DISTRIBUTED IN ANY FORM EXCEPT BY PAINLESS ACCOUNTING,
  25.                INC.

  27.     __________ I understand that the source code can only be purchased
  28.                by US citizens, or US permanent residents. This source
  29.                code is to never leave the continental United States.
  30.                Currently we do not release the source outside the US due
  31.                to copyright laws, etc.
  32.  
  33.     __________ I understand that the source code can only reside on one
  34.                PC. This PC cannot be connected to a network.
  35.  
  36.     __________ I understand that only two people can have access to the
  37.                PC where the source code resides.
  38.  
  39.     __________ I understand that if an outside programmer/contractor is
  40.                to modify the source code, the modifications must take
  41.                place at the purchasers place of business.

  43.     __________ I understand that the source code cannot be taken offsite
  44.                (away from the purchasers place of business) at anytime.
  45.  
  46.     __________ I understand that the source code cannot be viewed or
  47.                edited from a remote PC.
  48.  
  49.     __________ I understand that the compiled version of the source code
  50.                (.EXE) can reside on upto 10 PCs at the purchasers place
  51.                of business. Additional licenses are available.
  52.  
  53.     __________ I understand the source code (not even a single line)
  54.                cannot be used in any other programs.
  55.  
  56.     __________ I understand that no copyright messages or logos can be
  57.                altered, suppressed, or removed. This includes all .PCX,
  58.                data files and program files.
  59.  
  60.     __________ I understand that Painless Accounting, Inc. is in no way
  61.                obligated to fix or update the source code.
  62.  
  63.     __________ I understand that Painless Accounting, Inc. does not
  64.                provide technical support of the source code.
  65.  
  66.     __________ I understand that the source code comes "As Is", "with all
  67.                faults", and in lieu of all other warranties and
  68.                conditions, expressed or implied, including, but not
  69.                limited to, those for merchantability and fitness for a
  70.                particular purpose.

  72.     __________ I understand that the purchase price of the source code
  73.                is non refundable.

  76.     __________ I understand and acknowledge that the source code and all
  77.                user's manuals and other supporting documentation
  78.                constitute valuable property of Painless Accounting, Inc.,
  79.                and that all title and ownership rights in the source code
  80.                and related materials remain exclusively with Painless
  81.                Accounting, Inc.

  83.     __________ I understand that Painless Accounting Version 6.1,
  84.                Painless Payroll Version 6.1, require FoxPro 2.5
  85.                compile and link. FoxPro products can be purchased
  86.                directly from MicroSoft.

  88.     __________ I understand that the source code will come complete and
  89.                ready for compilation and linking. I understand that a 
  90.                simple batch (.BAT) file will be provided as an example. 
  91.  
  92.     __________ I understand that Painless Accounting, Inc. shall not be
  93.                liable for any incidental or consquential damages suffered
  94.                by myself through the use of the source code, wether or not
  95.                such damages were disclosed or reasonably foreseen.
  96.  
  97.     __________ I understand that if any part of this contract is broken
  98.                or violated in any form, I am completly and totally
  99.                liable. This liability has no maximum amount, but will
  100.                not be less than $15,000.00, plus all legal costs
  101.                incurred.
  102.                Just a reminder here: There are several checkpoints in
  103.                Painless Accounting, Inc. source code so we can prove
  104.                ownership. (I hope we never have to prove this.)
